Chapter 1. General Provisions
Article 1 — Acceptance of Terms
Whomi Global Inc (the "Company") provides its services on the condition that you (the "User") agree to these Terms. The Company's online civil-affairs agency services ("Services") — including domestic and overseas document issuance agency, translation, notarization agency, Ministry of Foreign Affairs apostille, consular confirmation and embassy legalization — and your use of the Services are governed primarily by these Terms. The Company further undertakes that documents it issues are free of any forgery or alteration, and that submitted documents are securely destroyed after use.
Article 2 — Purpose
These Terms set out the conditions and procedures for using the Services provided by the Company, together with other necessary matters.
Article 3 — Effect and Amendment
(1) These Terms take effect when announced to Users via notice, e-mail or other means. (2) The Company may amend these Terms; amended Terms take effect in the same manner.
Article 4 — Rules Outside These Terms
Matters not specified herein are governed by the Certified Administrative Affairs Act and its Enforcement Decree/Rules, the Framework Act on Telecommunications, the Telecommunications Business Act, and other applicable laws where such laws so provide.
Article 5 — Definitions
- Member: a person who has entered into a service-use agreement with the Company.
- ID: a combination of letters and numbers chosen by the Member and approved by the Company for identification and service use.
- Password: a combination of letters and numbers set by the Member to protect their confidentiality.
- E-mail: mail sent over the Internet.
- Termination: an expression of intent by the Company or Member to end the service-use agreement.
Chapter 2. Membership & Use of Service
Article 1 — Application
(1) An application is formed by the applicant's submission of a use request and acceptance of these membership terms. (2) An applicant must provide the personal information requested by the Company. (3) The information you provide must be true, clear and accurate, and you must keep it current.
Article 2 — Formation of the Agreement
(1) The agreement is formed when the Company accepts the applicant's request. (2) Upon acceptance, the Company notifies the User of the member ID and other matters it deems necessary. (3) The Company may decline applications that: (a) use another person's name; (b) are not in the applicant's real name or contain false information; (c) are made to disturb public order or morals; or (d) fail to meet the Company's stated requirements. (4) Where acceptance is withheld or declined, the Company shall promptly inform the applicant, except where notice is impossible through no fault of the Company.
Article 3 — Use and Limitations
(1) Business hours are 09:00–18:00 excluding public holidays; online intake is in principle available 24 hours a day, year-round. (2) Aside from regular system maintenance, the Company may restrict service use without prior warning for users who obstruct its business or other members through intentional interference, abusive language, defamation, or persistent unwarranted complaints.
Article 4 — Information & Advertising
(1) The Company may provide various information within the Services. (2) The Company may place advertisements on service screens, the website and e-mail. (3) Depending on a destination country's entry rules, the Company may replace the "Child Travel Consent notarization-agency service" with an "administrative agent translation confirmation."
Chapter 3. Obligations
Article 1 — The Company's Obligations
The Company shall, barring special circumstances, make the Service available on the agreed start date; shall use its best efforts to provide the Service continuously and stably; shall maintain and repair related facilities and promptly restore any failure; and shall promptly handle member complaints, notifying the member of the reason and schedule where immediate resolution is difficult.
Article 2 — The Member's Obligations
The Member is responsible for managing their ID and password; consents to receiving e-mail and advertising sent as part of the Service; must notify the Company of any unauthorized use of their ID; may not engage in additional commercial activity using the Service without the Company's prior consent; may not copy, reproduce, alter, translate, publish or provide to others any information obtained through the Service without prior consent; and must comply with these Terms and applicable laws. Members must not, among other things: misuse others' IDs or identification or commit fraud; register under a false or unidentifiable name; act for criminal purposes; harm public order or morals; defame or insult others; infringe others' intellectual-property rights; hack or distribute viruses; send unsolicited advertising; or otherwise impair the stable operation of the Service or violate applicable law.
Chapter 4. Refunds
Article 1. Members should apply with care. By applying, the Member clearly acknowledges that the Company's management and operating costs arise upon application, and fully consents to the collection of the resulting "refund fee."
Article 2. Refund fees and policy follow the published refund schedule. For civil-affairs matters where the customer personally completes the application form, refunds may not be available.
Article 3. The Company is not responsible for failed applications, wrong deliveries, or other errors arising from the Member's mistakes in address, application information, or other input.
Article 4 (Refund Fee). Notwithstanding Articles 2 and 3, to prevent repeated careless ordering and cancellation, and to cover the Company's costs of a refund (card-payment fees, bank transfer fees, taxes from revenue recognition, negative-revenue tax invoicing, seal engraving, application/power-of-attorney preparation, portal advertising fees, and other labor), the Member fully consents to refunds being paid net of such costs, calculated according to the time elapsed after application.
Article 5 (Mobile-Payment Refunds). Where a Member pays by mobile phone and then requests cancellation, the refund may be received after the period from the 1st of the month following the payment-settlement month plus two months (one month carrier + one month PG). If, within the month of payment, the Member prepays the handling fee to the Company, the Company shall cancel the mobile-payment authorization in full.
Chapter 5. Termination & Restriction
(1) A Member may freely terminate the agreement at any time. (2) Termination is effective when the existing ID/password no longer log in. (3) Where a Member breaches Chapter 3, Article 2 and fails to cure within a set period, the Company may terminate or suspend the agreement without prior notice. (4) The Company may, for a period, restrict re-application by a Member so terminated.
Chapter 6. Management of Member Postings
The Company may delete, without prior notice, content that: defames or slanders individuals or organizations; violates public order or morals; appears to constitute criminal activity; infringes others' copyrights or rights; or violates applicable laws or Company rules.
Chapter 7. Disclaimer & Liability
Article 1 — Damages
Except in cases of the Company's gross negligence, the Company is not liable for damages to a Member arising in connection with the Services; in any case, the scope of compensation shall not exceed the cost of the Service provided.
Article 2 — Disclaimer
(1) The Company bears no responsibility for the accuracy or reliability of information posted by Members. (2) The Company bears no responsibility for transactions between Members or with third parties conducted through the Service. (3) Where a Member's breach causes the Company loss, the breaching Member shall indemnify and hold the Company harmless. (4) The Company is not liable for harm caused by local public holidays abroad, natural disasters, or other unavoidable causes for overseas applications. (5) Event payouts (e.g., lowest-price guarantees) are made only to customers who attend on the notified date with all required documents. (6) For loss caused by a Member's breach of Chapter 3, Article 2, the Company may claim damages and file a complaint, and the Member agrees not to object. (7) If an overseas courier loses an original document submitted by a Member, the Company compensates the Member up to US$100. (8) If a Member provides forged or altered documents, the Company may immediately report it to the authorities and claim damages, and the Member agrees not to object.
Article 3 — Dispute Resolution
(1) The Company and Members shall make every effort to resolve disputes amicably. (2) Notwithstanding the foregoing, any litigation shall be subject to the jurisdiction of the court having jurisdiction over the location of the Company's head office.
Addendum
Article 1 (Effective Date) — These Terms take effect from the Company's opening date (May 11, 2015).
